On November 1, 2023 new Sentencing Guideline Amendments became law. These retroactive Amendments mean that thousands of currently sentenced and incarcerated federal inmates can apply for a reduction in their sentence.

What‘s a 2255 Petition?
Under federal code 28 U.S.C. § 2255, a prisoner who claims the right to be released on the grounds that their prison sentence was imposed in violation of the Constitution, or that the court did not have the authority to impose such a sentence, or the sentence was unlawfully excessive, may file a motion to set aside or correct the sentence. Although there are circumstances when an inmate may file a 2255 Petition at anytime during their incarceration, there are rules in place that generally allow for a maximum of one year from the date on which your sentence became final, in which to file.
